Our Terms of Service

From Our Warehouse to You

The products on display reflect our warehouse stock, ensuring the fastest possible order fulfilment. The prices shown include all applicable taxes. Shipping costs are clearly indicated in the shopping cart, based on the chosen delivery method and any promotions. You can use the online shop to order haberdashery items, accessories, underwear and hosiery products for private use. Orders for resale are not permitted.

Shipping

We ship by express courier throughout Italy. Our packages are carefully packed and recycled for a lower environmental impact. Deliveries are usually made within 1-2 days of order fulfilment, but for some areas, additional days may be required. Our information in this regard is based on the shipments made, therefore we will not be held responsible for any delays on the part of the courier. We ask customers to specify their mobile phone number when placing an order, in order to facilitate delivery by the courier.

Right of return

Pursuant to Article 49, paragraph 1, letter h of Legislative Decree No. 206 of 6 September 2005, consumers may withdraw from the contract within 30 days of receiving the products purchased on modamerceria.com, without providing any specific reason, as a simple change of mind is sufficient. Below is the information regarding the exercise of the right of withdrawal according to the scheme set out in Legislative Decree 206.
You have the right to withdraw from the contract, without giving any reason, within 30 days.

The withdrawal period expires after 30 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods. To exercise your right of withdrawal, you must inform Moda Merceria customer service, Via della Pisana 61/a ROMA 00163, Tel. +39 06 66012452, e-mail: [email protected], of your decision to withdraw from this contract by means of an explicit statement sent by e-mail. To comply with the withdrawal period, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of withdrawal

If you withdraw from this contract, you will be refunded all payments you have made to us, excluding delivery costs, without undue delay and in any case no later than 30 days from the day on which we are informed of your decision to withdraw from this contract. Such refunds will be made using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a result of such refund.
The refund may be suspended until the goods are received or until the consumer has demonstrated that he has returned the goods, whichever is earlier.
Please return the goods to Moda Merceria s.a.s. Via della Pisana 61/a ROMA, Cap. 00163, without undue delay and in any case within 30 days from the day on which you notified us of your withdrawal from this contract. The deadline is met if you return the goods before the 30-day period expires.
The direct cost of returning the goods will be borne by you, and
you may use a courier of your choice. You are only responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. The products must not have been used, worn, washed or damaged; the products must be returned in their original packaging, including the label (the packaging must be sealed as originally; if you wish to return a kit, you must return all the items that comprise it).

Pursuant to Article 59 of Legislative Decree 206/2005, please note that the right of withdrawal referred to in Articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to:

a) the supply of goods made to measure or clearly personalised.
b) the supply of sealed goods which are not suitable for return for reasons of hygiene or health protection and have been unsealed after delivery.

Data protection and security

"Moda Merceria" stores both the data entered when completing the order and the order itself. All data recorded by us is used and processed exclusively within the framework of the current data protection legislation in accordance with our data protection provisions. 

No sensitive data will be collected by us. Credit card details are not processed by us. 

Payment in instalments with Alma

Payment in instalments/deferred payment is available through our partner Alma. Payment security is guaranteed by Alma and its service providers. All payments are protected by 3D Secure.

Purchase amount

• P2X: Only purchases between £50 and £2,000 are eligible for payment with Alma.
• P3X: Only purchases between £50 and £2,000 are eligible for payment with Alma.

When paying in several instalments with Alma, the Customer does not pay any fees.
Alma is a remote payment manager and issues an electronic certificate that will be considered as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.
Any termination of the GTC between the Seller and the customer will result in the termination of the GTC between Alma and the customer.

Applicable law and jurisdiction

This Agreement is governed by the laws of the Italian Republic. The Court of Rome shall have exclusive jurisdiction over any disputes.
